very simple....cons hide behind religion....i catch more contraband after a church service then any other time...its like trick or treat when the cons come walking out bibles in hand in shanks in their socks....

The OP and (surprise) WorldNet Daily are both in error, in that the court did not declare atheism a religion. The court found that a religion can be atheist. That ought to be rather obvious. For instance, many Buddhists are atheists. The court did not find that atheism, as such, is a religion.

The court held that, for first amendment purposes, atheism will be considered a religion:

The court, of course, wouldn't touch the non-legal question, whether atheism is actually a religion, with a 10-foot pole.
