Jan. 6 rioters who U.S. says ‘ignited’ path for Capitol attack convicted

They were five men from five different states who’d never met each other. But on Jan. 6, 2021, they found themselves together at the front of the angry push by rioters toward the U.S. Capitol. And together, video showed, they lifted a line of five linked barriers and heaved them into a group of five Capitol Police officers with such force that one of the officers went airborne, striking her head and falling briefly unconscious.

Ryan Samsel, 39, of Bristol, Pa., was the most prominent of the group, first unlatching the barricades at an unguarded spot on the Peace Circle, then leading the crowd toward a second line where he yelled at police and was part of the effort to launch the bike racks at the five officers, video played at trial showed. He has been in jail since January 2021, in part because of multiple violent assault convictions in previous years, mostly against women, and a pending arrest warrant for violating a restraining order.

Samsel did not take the stand in his own defense. Nor did any of his co-defendants: James T. Grant, 31, of Cary, N.C.; Paul R. Johnson, 38, of Lanexa, Va.; Stephen C. Randolph, 34, of Harrodsburg, Ky.; or Jason B. Blythe, 28, of Fort Worth.

State Dept. diplomatic security officer charged with Jan. 6 trespassing

Kevin Alstrup of the District worked as uniformed security officer, is not accused of violence or vandalism​

A diplomatic security officer for the State Department was arrested in the District on Tuesday and charged with four misdemeanor counts related to his alleged actions entering the U.S. Capitol during the rioting on Jan. 6, 2021. He is not accused of fighting with police or committing any damage as he reportedly entered, walked around in and left the Capitol that day, which investigators determined through multiple videos and photographs.

A LinkedIn page that appears to be Alstrup’s states that he has worked as a security officer since 2010, that he has held top secret clearance and was sworn in as a special deputy U.S. marshal.

Henry Phillip “Hank” Muntzer, 55, was found guilty in U.S. District Court for the District of Columbia of obstruction of an official proceeding and civil disorder, both felonies, following a bench trial before U.S. District Judge Jia M. Cobb. [as well as some misdemeanors]

Muntzer was arrested by the FBI on Jan. 18, 2021. [link to previous thread]

Muntzer recorded multiple videos in which he commented that he had passed “through all the tear gas” to “tak[e] the Capitol by storm.”

Aaron Sauer, 43, who the FBI says was affiliated with the Proud Boys and went by the moniker "Roni," faces at least nine charges, including felony counts of civil disorder and assaulting officers. The Justice Department alleges that Sauer was wearing a bulletproof vest when he assaulted law enforcement officers with pepper spray and helped destroy a black metal fence on the west side of the Capitol on Jan. 6, 2021.


Prosecutors said Sauer traveled to Washington with Dominic Pezzola, a Proud Boys member who smashed a window at the Capitol and was sentenced to 10 years in federal prison. Sauer also traveled with Matthew Greene, a Proud Boys member who pleaded guilty in December 2021 and is cooperating with the government. Sauer, the FBI said, was also seen with William Pepe, a Proud Boy from the Hudson Valley of New York who has also been charged in connection with Jan. 6.

Peter Michael Krill, 54, of Sewell, New Jersey, is charged in a criminal complaint filed in the District of Columbia with two felonies: assaulting, resisting, or impeding certain officers; and civil disorder; and four misdemeanors:
Peter Michael Krill, Jr., 55, of New Jersey, was sentenced to nine months in federal prison with 12 months of supervised release. He was ordered to pay $2,000 in restitution, authorities said in a news release. Krill pleaded guilty in October to a felony charge of civil disorder.

The plan would have seen the Trump campaign pushing Republican lawmakers to prevent Congress from certifying Joe Biden’s win not just on Jan. 6, but for days afterwards. GOP legislators would have feigned confusion over competing slates of electors, paralyzing Congress as the Trump campaign brought increasing pressure on the Supreme Court to step in and resolve the election in their favor.

To do this, Chesebro formulated various ways to invalidate the Electoral Count Act, the law laying out the procedures for Congress to certify the election on Jan. 6. Critically, the law places tight limits on how long individual lawmakers can debate disputed electoral votes — nullifying or inflating those limits, capped at five minutes per member and two hours total, could make Jan. 6 go on indefinitely.

Anti-vaccine protester now charged with assaulting officers on Jan. 6

Mitchell Bosch, who had previously run for the New York City Council, yelled "hold the line!" as the mob fought with officers on Jan. 6, according to the FBI.

Bosch, according to an FBI affidavit, "can be seen in multiple instances" on video of the riot "opposing the police advance by pushing directly against the officers, assisting other rioters in pushing against officers, and encouraging other rioters to oppose the police."

Bosch had previously run for the City Council as a Republican, and the New York Post had documented his arrests at a Cheesecake Factory, an Applebee's and a Burger King in December 2021, when he was opposing the city's vaccination mandate. Bosch was also arrested at the Museum of Natural History in January 2022 while protesting vaccination mandates, according to the Post.

There have been a number of arrests of Jan. 6 defendants in recent days. Daniel Hatcher, Nathan Mackie and his brother Brandon Mackie were also charged in a case unsealed Wednesday, and Thomas Method was arrested in Massachusetts. Cameron Clapp, a triple amputee, was arrested in California on Tuesday.

Brandon Fellows, 29, was sentenced to 3½ years in prison as an exasperated federal judge boomed, ‘It’s time for you to grow up!’​

A tree cutter who smoked marijuana in a senator’s office during the Jan. 6, 2021, attack on the U.S. Capitol was sentenced to 3½ years in prison Thursday after his strategy of interrupting and challenging the sentencing judge seemed to blow up in his face.

Fellows, from Upstate New York, chose to represent himself through most of his legal proceedings and was found in contempt at his trial after calling U.S. District Judge Trevor N. McFadden a “modern-day Nazi” running a “kangaroo court.”

In a court filing Tuesday that he conceded was “rambling,” Fellows continued to assert that “the election was stolen, and we had and have a right to go in and throw the people out who made this happen.”

Deputy who claimed to help police sentenced in Jan. 6 attacks on officers

Off-duty Tenn. sheriff’s deputy Ronald McAbee, who assaulted two police officers and dragged one down steps, was sentenced to 70 months in prison​


Ronald McAbee, 30, struck D.C. police officer Carter Moore twice in the face while wearing hard-knuckle gloves and a bulletproof vest with two patches that read “SHERIFF” and “III” (for the Three Percenters right-wing, anti-government movement).

Moore was trying to help a fallen D.C. police officer, Andrew Wayte, after a third officer had been dragged down the steps and beaten at the entrance of a bloodily fought-over tunnel at the Lower West Terrace at about 4:30 p.m. Video showed that McAbee, another rioter and police then grabbed hold of Wayte and began pulling in different directions “in a violent tug-of-war with Wayte’s defenseless body as the rope,” U.S. District Judge Rudy Contreras said at McAbee’s sentencing hearing in D.C.

Contreras said McAbee came armed to Washington saying he was ready to fight for children and future generations, suggesting he was not thinking about self-defense from counterprotesters, and posed for a photograph the following day holding a newspaper with the headline “INSURRECTION.”

McAbee pleaded guilty in September to assaulting Moore and was convicted after trial in October of Wayte’s assault. He was sentenced on all seven counts charged by prosecutors including felony rioting and trespassing on restricted Capitol grounds with a deadly or dangerous weapon (his reinforced gloves).

Some Jan. 6 rioters received improper sentence enhancements, appeals court rules

The challenge was brought in the case of convicted rioter Larry Brock.

The three-judge panel ruled that defendants convicted of obstructing the congressional certification had received improper enhancements of their sentences from district court judges who determined their actions amounted to "substantial interference with the 'administration of justice.'"

In their ruling, the panel of judges upheld Brock's conviction but ordered the district judge overseeing his case to resentence him and remove the enhancement he had previously included

The ruling comes as the Justice Department is preparing to make its case before the Supreme Court to not overturn a key felony obstruction charge used against hundreds of rioters that defense attorneys have argued stretches beyond what the statute intended.
