A Tennessee man who was recently convicted of assaulting a police officer during the Jan. 6, 2021, attack on the U.S. Capitol was found guilty in a separate case Wednesday for plotting to kill the law enforcement agents who investigated his role in the insurrection, the Justice Department said.

A federal jury convicted Edward Kelley, 35, of Maryville, Tennessee, of conspiring to murder federal employees, including FBI agents. Prosecutors said he created a “kill list” of the law enforcement staff who investigated him and had planned to attack an FBI office in Knoxville, Tennessee, with car bombs and incendiary devices.

Seven months after Kelley’s arrest for assaulting an officer [on Jan 6], the Justice Department said he and a co-conspirator, Austin Carter of Knoxville, were charged with conspiracy and retaliating against a federal official, among other offenses. Officials alleged that the pair discussed collecting information and plotting to kill law enforcement officials who had investigated Kelley. Carter pleaded guilty in the case in November 2023 but has not yet been sentenced.

Edward Kelley wanted revenge after he was arrested and accused of fighting with police and trashing the U.S. Capitol on Jan. 6, 2021. He enlisted two friends in a plot to attack the Knoxville, Tennessee, FBI field office that had investigated him. During a meeting with the friends, court records show, he told them, “With us being such a small group, we will mainly conduct recon missions and assassination missions.”

The pardon order includes everyone “convicted of offenses related to events that occurred at or near the United States Capitol on January 6.”

Some legal experts said Kelley’s legal argument was likely to fail, while acknowledging that Trump’s order isn’t entirely clear.

“It is clear from the President’s executive action,” [defense lawyer] Brown wrote, “that he intended his executive order to sweep broadly. If he had wanted it to apply to just the actions of January 6th he would have said so. Rather he styled his executive action as ‘related to’ events that occurred at or near the Capitol on January 6, 2021."
