Judging by your post, your problem isn't lack of punishment, your problem is this:

I did realise though that everytime he cried about something we would "discuss" it with him and go do what he wanted to do anyway as a way to show if he appologised it was ok.

You haven't been setting effective boundaries at all.

A child without boundaries is not a happy child because they never know where their place is.
