The gross-up clearly indicates that Cohen was an intended and acknowledged conduit for the payment, not a legal fee.

From the collective testimony and evidence (emails) to date, it's abundantly obvious the election was the primary motivation. The Stormy story was killed right after the Access Hollywood tape -which was spun as "locker room talk." If both stories had gone public within days of the election, we all know the damage that would cause politically. As did Trump.

It is not the killing of the story, nor for the payment to Ms Daniels nor even for the repayment of Cohen but the manner in which the repayments were listed in the Trump Org’s ledgers; to hide what would have been an illegal campaign contribution (uncharged crime) by couching the repayments as “legal fees” (which they were decidedly not).
