The AZ Senate voted to repeal the 1864 law....but the repeal won't go into effect until 90 days after the legislative session....leaving health care providers in a gray area.

The Arizona Senate has voted to repeal the Civil War-era near-total ban on abortion that had been recently revived by a court ruling, setting the stage for it come off the books later this year.

The repeal passed by a narrow margin — 16-14 — with two Republicans joining Senate Democrats.

The repeal bill goes soon to Democratic Gov. Katie Hobbs, who has promised to sign it. But lawmakers lacked the votes to make the repeal effective immediately, meaning there could be uncertainty for months about whether it can still be enforced.

Newly-signed bills don’t go into effect until 90 days after the end of the legislative session.

Why? Not enough women's lives are being put at risk as it is?
To protect the most innocent. I believe it should only be used to save the life of the mother and nothing else.

Unfortunately such laws do not work, endanger women's lives and have caused many deaths.

Arizona was going to be a tight race in November....now with the States Supreme Court upholding a Civil War era law, I expect Republicans will lose across many races as many will be voting for the ballot measure to protect a woman's right to chose. The law is on hold pending review by a lower court (details pending).

"The Arizona Supreme Court on Tuesday upheld a 160-year-old abortion ban that could shutter abortion clinics in the state, saying the law that existed before Arizona became a state could be enforced going forward.

The ruling indicated the ban can only be prospectively enforced and the court stayed enforcement for 14 days. But it's already causing political earthquakes.

The pre-statehood law mandates two to five years in prison for anyone aiding an abortion, except if the procedure is necessary to save the life of the mother. A law from the same era requiring at least a year in prison for a woman seeking an abortion was repealed in 2021."



I'm glad old laws that were never officially abolished are still adhered to, at least by some.

And God does not change.

He doesn't like abortion more today than he did 100 years ago. Why should we?

Which is why we must do both to protect mother and child. Both lives are valuable. They don't deserved to be destroyed.

Democrats supported Roe, which was not "legal at all stages".

There isn't some magical procedure out there that can save both, if there was people would use it. Sometimes it's one or the other, or the baby is unable to survive.

Why should people compromise on a life saving procedure to satisfy the sensibilities of religious ideologues?

In Ireland, where I lived most of my life, abortion was strictly illegal until ten years ago. Although in theory saving the mother's life was an exception, the laws were unclear so doctors simply wouldn't do it because a mistake would land them in prison. You see, medicine is not an exact science and many times doctors have to weigh treatment on a percentage scale... "This is 92 percent likely to happen so treatment should be...". Women in Ireland were dying because of it's illegal nature:


This was the most recent and well known case. People were so outraged the population held a referendum to overturn the law, and it won overwhelmingly. A few years ago my husband was killed in an accident and upon being informed by the police the shock caused me to have a miscarriage. Had it been ten year earlier I'd most certainly be dead because the doctors would have been unable to treat me.

I'm not American, I'm just providing related commentary.

I'm not a Christian, I'm an orthodox Jew... so is it okay for me to ban you from eating pork and lobster? Can I ban you from working sundown Friday to sundown Saturday? Can I ban tattoos? Can I make it illegal to nookie with your spouse during her menstrual cycle? After all, those laws are from HaShem himself!

my only prayer is for both the mother and baby to survive, I cannot and will not support abortion in any way, shape, or form

Even Ben Shapiro, as an Orthodox Jew, was very much opposed to abortion.

I said nothing theologically wrong.

Furthermore, if you disagree with me that is fine. I 100% respect everyone’s right to have their own views. That’s your right. Agree to disagree and move on.
