This was actually the Evan McMullen plan in 2016. He needed to win ONE state AND ALSO Trump and Clinton needed to both miss out on getting 270 electoral votes. It could have worked, except that in 2016 McMullen won ZERO states and Trump got MORE THAN 270 electoral votes. It was for McMullen a long shot strategy but a fully legal and constitutional strategy. It just didn't work for him.

Well, technically, this is not a "dirty little secret." It is not a secret at all. It is the 12th Amendment to the Constitution. It is available and applicable to either party, any candidate, and any time the need arises. But the conditions have to be met.
It is like saying Trump's dirty little secret to get elected is to have the most electoral college votes! Gasp! Those dang voters. Kamala would have won except for the voters voted for Trump!!!!

I am sure all of the hot shot lawyers are gaming this out if nobody gets the 270 needed electoral votes. It DOES work out better for Trump as he will probably win a plurality of states.

It's NOT a dirty little secret. It's the constitution. To win without it being thrown to the House you have to have an actual majority of electoral votes. If nobody has that majority the House decides, based on the states each providing one vote.

The McMullen strategy was to finish in the top three electoral vote getters. It's actually not a bad strategy for a third party candidate who can get a few electoral votes (a BIG hurdle) and prevent the other candidates from getting to 270. Then hope that the Left blocks the Right and the Right blocks the Left so you look like an acceptable compromise candidate. In this election I don't see, short of a miracle, that anyone but Harris or Trump will get an electoral vote. McMullen had a ghost of a chance winning Utah as he was a Mormon, but nope. I wish we would have a groundswell for another candidate, but it ain't happening. So many people LOVE Harris and LOVE Trump. Or, um, whatever.
