That's funny!!! If that was the case, why are there so many lawyers I know who graduated in the top 15% of their class, scored highly on the bar, and can't find a job? I wish the media would get their facts straight when reporting stuff that lawyers do, or at least report more of the story that would explain everything.

It's their own fault for not going into a more noble profession like engineering, :P although I remember how quickly our class dwindled after the first and then the second semester of Calculus. I guess numbers unrelated to $$$ are just not important to some people :( and I detest having to do any kind of accounting.
You're right, though. My mother has stated that insurance would have been easier, self-perpetuating money than the real estate game. Lawyers do make a nice sum on every real estate transaction, be it title work, mortgage docs, deed prep, etc. so I don't feel too sorry for them. ;)

I found this out very early on when I thought a client fully understood the blue prints of a plan, but only was afraid to admit they didn't for fear of looking stupid ....geez! Instead there were walls in places that they could not understand, etc.
What's stupid bout relying on someone else who's more expert in their field? Would they do their own surgery as well? It's these humans that make me nuts sometimes. I'm telling ya!

I don't get that either. My grandma died a couple years ago, and there was this issue with getting her house and land properly appraised and sold. I know nothing about real estate, they know nothing about real estate. However, I became a family pariah because I suggested hiring a real estate agent to sort it out for us and tell us what to do. The idea of paying someone 7% was just unfathomable. I had even found a friend willing to do it for a fraction - like 3%. There are still family mad at me for that one. They thought my mom should have just gone through the bank, even though she didn't know what she was doing.
I hear you! Some clients think their cases are worth so much more than they are, and we are pretty blunt up front, but they still swear we led them on.

Porteross, do you work for an architect or building contractor? I was a residential architect's apprentice for four years. The thing I hated the most was when the wife of the client would bring these shoe-boxes with all her clippings. They didn't even have the floor plan worked out and she had every room done. I would let her go through it and ask if I could keep it for referrence. They would usually be delighted. Then we could concentrate on the floor plan. Regardless, it was one of my favourite jobs. I was devastated when Mr Johanssen died. None of the local architects wanted to pick up my aprenticeship. The market had gone flat and they couldn't afford the extra payroll.
Because of this background my favourite movie at the time was, 'Mr Blandings builds his dream house,' with Cary Grant. I would laugh all the way through it. The remake of it was pretty good too (the money pit). Mr Johanssen had a copy of Mr. Blandings, on 35mm film and would often have his customers watch it before he would do a plan for them.
As for (shudder) lawyers. I've never met one that had enough ethics or scruples to fill a thimble. Perhaps it's just luck. Seems for the last thirty years if I've had luck, it's bad luck.
I'm praying for improvements.

Actually, legal ethics is stricter than Christian ethics, believe it or not. For example, as a Christian, you can get away with not telling a lie by just not saying anything. There are all kinds of times when lawyers are required to disclose information, and it has to be truthful information to the best of that lawyer's knowledge (clients will say anything they want to a lawyer, and until the lawyer can find out otherwise, they have to go with the word of the client). That's why when someone says they need to find a "Christian" lawyer, I just laugh. You are going to get the same level of representation regardless of the religion of the lawyer. If you need a lawyer, you find someone who is experienced, and familiar with the courts you are in.
Stud - I'm sorry your experience with lawyers hasn't been good. There are bad lawyers out there, just like there are bad doctors. However, I have yet to meet someone who went through a divorce, child custody matter, or bankruptcy who actually liked their lawyers. Maybe half of the people I know who had personal injury cases liked their lawyers. Not only is it human nature, it's the lack of understanding of the layperson of the process and the law on the subject. Can't tell you how many people think their cases are worth tons more than they are - doesn't make them right and us wrong, and do you think they will be happy with us when we disengage them once our research shows they don't have a case? Of course they are going to think my boss has no ethics and I'm his evil minion. Lawyers have to work within the laws - they can't just get a result because that's what you think they should get. Don't like the precedent, find a lawyer that thinks they can change precedent, or keep track of your judges so you can vote knowingly on whether or not to retain them.

Another thing that gets me. On this board I used to be one, once people found out that I work for lawyers and don't think they are so bad, would dedicate threads on how awful lawyers are. However, when someone needed legal advice, all of a sudden I became their best friend, and they got quite mad at me when I told them I couldn't get advice.
There was a lawyer on the board who was afraid to make his profession known. He only told me in a PM when he found out what I do. He eventually made his profession known and he gets it worse than I do. Someone will ask him for legal advice, he will give it, they don't like what he has to say, then he's a bad person. He doesn't make the law.
People never cease to amaze me.

If it makes you feel any better, Flipper, my firm has bee slammed in the press, along with ignorant bloggers, here for about 2 weeks all due to a client's removal of a state historical marker on his property that we are brokering. It is merely an informational marker and not a registered state landmark, but people are up in arms accusing us of being money-grubbing and willing to sell county treasures, blah, blah, blah.
The house needs to demolished or at least extensively, structurally renovated (which will cost as much, if not more than it's selling for) and I have said so publicly. The 100 year old adobe walls are collapsing under their own weight because of poor initial construction, the weight of modern roofing, massive tree roots too close to the structure (God knows that tree is a treasure too and cannot be removed) and its location next to a creek that flooded and wiped out numerous other houses 8 years ago. It is dangerous as it stands and seemingly destined to give way to natural forces eventually, but as to when that might happen, it's hard to say without monitoring the movement of the walls. I'm not a PE and no one would pay for that kind of study.....and I put this to the Historical Commission to put their money where there mouth and buy the house IF they indeed are so concerned about its future.
My office has nothing to do with the seller's decision to merely get the sign out of the way whilst he cleared the lot, yet we have been accused of instructing him to do so in order to find someone willing to buy the old eyesore, not knowing it's controlled by the state historical mandates, which it's not. In fact, it is not worth much and is not going to make us any significant money when it does sell so we find this all very humorous.
The only comment I made on the blog, because my parents were beside themselves about the nasty comments made by anonymous posters, of course, was that this is the US and in Texas, which consists of more than 90% privately owned land, there are laws purposely put in place to protect land owner's rights against just the sort of socialist tyranny these uninformed busybodies would impose. Not only that, but because this online paper kept posting incorrect information based on hearsay of those with no actual knowledge of the situation, they were libelling us and our cadre of legal minds in Austin sit ready to assist us with a healthy, rarely used legal fund!

Also, I just spend too much time here. I need healing of my body and mind, and CF stresses me out too much to do that. More my fault than anyone elses.

Porteross, seems to me that you've been attacked by the hysterical society(LOL)! Yes, it would be nice for the HS in this country to be able to back their retoric with action. The problem is that when they have the money, it seems to be spent on... other things. Some of them are genuinely interested in saving and preserving historic properties. Others seem to just annoy and interfere.
It is very sad that the owners of this house, over several generations, have allowed it to go to... um, ah, heck in a handbasket. Adobe never was a very stable construction material. Many of the Missions in California that were constructed of this had to be taken apart (at great expense) and re-constructed with concrete and rebar reinforcement to preserve the original structure. Even the roofs were poorly constructed. They did what they could with what they had. And that was very little.
Still, our country seems to be of the mind that anything over ten years old is trash and should be cleared away. Between slum lords and careless owners, many historic districts in our cities and towns have become eyesores. This is a crying shame. Most of this could have been avoided with just a little normal maintenance. Ah well, what can I say, human nature...
It's sad when a truely historic structure becomes a burden on it's community. It's worse when one is the owner of said structure and had no hand in it's neglect and eventual demise. The situation sounds like it has become a lose, lose, proposition for everyone. Sometimes though, it takes something like this to kick people into action. I've seen many a case when a historic property was literally on the verge of collapse (like you describe this one) and the historical society and the community finally put their money where their mouths were. Choices will have to be made. Does the community want the tree or the house? Are they willing to cough up the wherewithal to deal with the situation? Otherwise they must stand aside and allow the owner do what it's their responsibility to do. Since he can't afford to repair and restore the building, it has to go.
Still, you must admit, the town will be the poorer from the loss of it.
God bless and keep you and your firm whilst you deal with this very emotional issue. May he give you all the strength to stand against the vituperation and anger it produces. This too shall pass and when it does, everyone will wonder what the big deal was all about.

I will miss you seajoy. You are in my thoughts and prayers as you work through the healing you need.
We all need to remember that there are people behind their posts. People who have feelings and things going on in their lives that we may not know about. Yes, we need to not give more power to things here than they deserve. Yet, sometimes we find ourselves particularly vulnerable to things being said due to our personality, our hurts and pains, our previous experiences.
Sometimes we need to take breaks from those things that are a hinderence to us in healing from those things.
We have a couple of members here who are hurting. Those are what we know about, how many others may be dealing with things that we do not know about.
Let's be supportive of those who feel a need to leave either temporary or permanently.

Protecting our clients is taken very seriously. I'm only silly and fun on here, y'all. :P
Oh my! I know nothing about real estate and property rights, and don't pretend to, but what you said seems to make sense. I think anyone who provides a service gets a bad rep, period, because uninformed people think they should get something that they can't, or that things should be a way that they just aren't, and just can't fathom that they don't have all the information. I think our media plays a huge part in that - they just report a fraction of what is really going on - sometimes that's all they have, and sometimes that's what they choose to do.
I guess I need to learn a little more about real estate because of these landfill cases we are working on - you can imagine what that's all about. Subdivision built on landfill...no disclosure...stuff seeping into houses...sinkholes swallowing houses...diminished property values...
I think I've talked more about work in the last few weeks, than the 4 years I've been here. I take work very serously too - maybe too seriously sometimes. You have to find a way to separate yourself from it, or you go crazy. I think that's why the firm provides beer for after hours. I'm surprised I'm not an alcoholic.
Ok, Kagome, I'm sorry I misunderstood you. Media law to me is fascinating and frustrating, what little I know about it. Our firm settled a case during a trial recently having to do with media law. The story was in the news so I can talk a little about it. Basically, big massive well-known computer company sued a mom and pop repair business for using their code without permission. There is something in the law that if you are in the busines of repairing, you can use certain code without permission. However, big bad company thought they could litigate the mom and pop out of business. Our firm took the case, countersued, and after 6 weeks of trial got a settlement that made the client very happy.

 I'm glad you understand I wasn't trying to put down your profession in any way! I understand that there are just some "bad lawyers" out there. Honestly, the last thing I'd be doing right now is in any way insulting the law profession! My sister is having to fight for SSI (she has Asperger's syndrome and has had back surgery for scoliosis [she was the first person doctors ever operated on that proved scoliosis can exist both as the "S-shaped curve" and "hunchback"] which was an operation to put two stainless steal bars in her back and then they had to remove some of her hip bone to help so one of her legs is a bit shorter than the other one).
I honestly don't know much about MEDIA law. . .couldn't tell you about the computer code usage and whatnot. I know quite a bit about MASS MEDIA LAW (that's journalism). What is public and what is private. What if somebody takes a pictures of people through their window (did you know that it depends on if the person was on the property or on public property). What makes a person a public image and why are laws different for them. What is fair investigation, what is the open meeting law, what is libel, what is slander, what's considered harassment.
so much law. . .which is just governed by MORE law. . .and yet, I just LOVE that subject! I've gotten myself into some heated arguments with friends over what I am allowed to write and what a Christian would write. . .or them. . .whichever. . .it can get so complicated!

The entrance to Great Lent for the Orthodox begins with the celebration of Forgiveness Vespers. I know that I have offended many during my time in TCL and I ask your forgiveness for any offense I have caused.
I will be logging off CF for the Lenten season but I'll come back to visit after Pascha.

When she found out she was pregnant and they did a sonogram on her, they said her umbilical cord had one artery and 1 vein running through it when there was supposed to be 2 arteries and 1 vein and there was a 25% chance something could be wrong with the baby when it was born, everything seems to be ok with him so far, seems real healthy.

As porterross said, it could be ear mites. It could also be an ear infection. One of my friend's dogs had an ear infection and did that - she had to put antibiotics in it for a week. I suggest you take your dog to the vet to have it checked.

A visit to the vet is an excellent idea. One thing an old vet told me, in regards to ear problems, was to regularly massage my dog's ears. She loves it and it's become habit for us. Nana Loves her ears massaged almost as much as having her bum scratched.
Darling's Nana (the real reason for Nana is because it's a German colloquilism for 'beloved one' and often used for Grandmother):

Micron's (that's my mom's little chihuahua and dachshund mix) sign name is basically "m little." It's an m and then while holding the m , signing "small" or if one handed, signing "m" and bringing the m in and tilting it down.

Luckily, the game is Aggieland. I try and avoid Waco!
Goodson's run was great, but that last drive was for the ages!
The night of T+1, we went to downtown Austin in my maroon car, lowered the windows, turned up "The Road Goes on Forever", and "Hulabloo, Caneck, Caneck"ed our way. We did this up 6th Street, up Lavaca past the Govenor's mansion, and up Guadalupe past the University. Got quite a bit of whoops on 6th!
Now, BCG needs to beat the 'sips here in Austin next week, and Coach Childress needs to beat Soggy Burrito in baseball to get the sweep. It's been so long since we've owned them in all three. But, late 2006 & early 2007 have been great so far!
Consistency on offense? I want the Wrecking Crew back! My first year there was '91 with Sam Adams, Quentin Coryatt, Kevin Smith, Marcus Buckley, Lance Teichelman, etc., and the D was No. 1 in the country. I expect that every year now, and have been sorely disappointed since '99 or so...

I've taken the first one before. . .gotta get just the right rating to be "Lutheran" it seems.
The second one, I'm right where I belong. . .and I even guessed that my 2nd result would be what it is. Had no idea that third would be Mennonite, though! I don't know much about them, but still, didn't know it would be!

Bizzy, bizzy. ;) The sun's not going down here until almost 7:00 so it's easy to get carried away outside with little time left to get ready for the next day....I love spring!
Does everyone else have plans for the patio or garden this spring?

Do I hear talk of Spring? What Spring? We are in the middle of yet another blizzard here! Power was out for 14 hours.
Now no power in the evening with a 6 year old would be interesting. For those of you passing the 6 year old around. My 17 year old had a hard time with it.
Red and Andi, prayers for you and your little one that this one makes it long enough before entering the world. May this little one be healthy.

It's heading our way tonight and tomorrow. Supposed to bring ice and rain. Coupled with the current snow and ice pack we have, there are flood warnings issued.
Yuck!!

We have all counties declared by the Governor as disaster areas. 40+ qualify under FEMA so the Governor is going through the process for a federal disaster declaration by the President.
Interstates north of Des Moines and west of Des Moines are closed and pretty much all roads to the north and west are declared "travel not recommended."
Now they are saying 14 inches or more.
Next week, we are to be in the 40's by mid week. Then we need to watch out for flooding.

I'm on the west edge of the whole thing. Snow is really coming down, nice to see the year and a half of drought break. Blew out the drive last night and it was back about as deep as the snowblower again. Just got done with about 4 hours of serious blowing, just a bit left to do but I'm going to sit awhile and have some soup.
I think I'll leave the store until tomorrow or Saturday, It's coming so fast that it won't matter much and we have to do that with a bobcat since we can't blow the snow on the other businesses. Don't like to push snow out here in the windy plains because a snow pile is just another name for a snow fence and it just drifts in deeper and faster if you start piling.
Tomorrow is supposed to be the bad day, big winds coming, all that snow going west today is going to go back east tomorrow. Got to move everything from the west side of the drive to the east side.
Oh well, cry me a river.

They were sure right about the wind. Had to drag the snowblower into the garage, it froze up and wouldn't move. Just ice, nothing serious.
I'm losing ground this morning, everytime someone drives through it throws up enough ridge the snow gets about 2 inches deeper in just a few minutes. At least the snow I get into the air doesn't come down again until a county or two away.
Lenten services were a no go this week. Actually a not held. But it looks like Sunday will be okay. Hope so anyway, my son is supposed to go to Bismarck for the state MathCounts meet, which is starting bright and sunny on Monday. Assuming they don't wait until half the kids show up and then cancel it.
I would go too but now I'm another week behind seed cleaning. So if the sun shines I better get to work.
Speaking of work, I'm going to go slip the Carhartt's on and have another go at the driveway.

Marv,
Your posts just make me tired! You are one busy fellow.
See you folks sunday night or monday. We are heading to daughter and son in law's place for the weekend. They adopted a new dog last week, so I have to go meet the only grandbaby I have at this point!

Can't wait for him to meet our beagle. Should be some real 'hound' fun! We hope the boys don't fight!

Ah, Andi, with the little one you are carrying, maybe you won't be noticing cold like others.
Redneck, Yeah I should have done some quilting, although I was expecting company this weekend (not coming due to the feet of snow and bad roads) so I was cleaning instead. Maybe some quilting on Sat. Yeah, that sounds like a better way to spend time than cleaning.
