Hi guys, I didn't really want to make a new thread for this, but if you could all do me a favor and say a prayer for my mother I would appreciate it.
Lately we have been getting calls from a group that always hangs up after my mom picks up the phone. From the caller ID it said something about portfolio recovery. Anyway after about a week of this we recieved a letter in the mail adressed to my brother who has been dead for almost 5 years now. The letter was from the same agency that had been callling, and apparently they are a collection agency. They are looking for money for a hospital bill from when my brother staid at NYU Hospital and my mother is steaming mad. After my brother died she called every hospital he staid at, to make sure that all the bills were paid, and that everything was sent to insurance companies on time, Yet after five years now they make an attempt to get the money for this bill. After she went thorugh eveything and all the she had to deal with insurance companies and case workers and, suffering through the death of her youngest child.
This is bringing up a lot of bad feelings for my mother, and she is very fed up, that after five years, and no contact, no attempt to send her a bill and collect the money, they now send a collection agency to gather the money that she had no idea they were even looking for.
She is reall angry right now, and I just need to ask that you please say a prayer for her

I think there is a statue of limitations.
If the bill was never sent, then they cannot collect after 6 to 18 months have passed.
With my insurance, they allow 6 months from the beginning of the new calendar year. So if the date of service was December 31, 2005, then the doctor would have to make sure that the insurance company receives it before June 30, 2006. If the billing arrives in the office after June 30, even if it is postmarked on June 30, then it is too late.
Check with your state.
I had a problem with a doctor who kept delaying in sending me his bill. Finally, two weeks before the deadline, June 14 of the following year, the doctor sent me the bill with a nasty note to pay it immediately. I faxed the note to my insurance company and it was ultimately paid. However, it was tense situation, because I received a notice from the insurance company on June 26 with an indication that they would not accept it without the proper paperwork to authorize my treatments. Then I had to contact the doctor and asked them to fax a copy of my files to the insurance company. If I had been on vacation, then I would have had to pay that entire claim (thousands of dollars) out of my pocket.

The problem is these bills are adressed to my brother, and the hospital has sold the debt to this agency so the same laws may no longer apply.
Also our insurance company has a policy that a doctors office that is out of network must send the paperwork within six months of the procedure or else they will not cover it (This Insurance policy is not state law). They may try to claim that they did in fact send a statement to the insurance company, but if they sent it too late the insurance company may have refused. So although they did not try to notify my mother, they may claim to have sent a form of notification even though it may have been to an insurance company. This is looking to be very complicated.

It boils down to who signed to guarantee the bill. If it was your brother, she can tell them to get lost. If it was her, then depending on the amount of the bill, plan b, c, and d must be considered.

Greg - I can't help with advice but rest assured that I will keep your Mom in my prayers [ and you of course] and you get a speedy end to all this hassle and you and your Mom are at peace.

Your mother is right. Eveyone has a boilingpoint. Sometimes you need to boil over and make certain people obvious they have gone too far.

This company has done just that, they bought out the debt from the hospital, probably on pennies for the dollar, and is now trying to get the money from my Mom. My mom is probably going to fight this. I
